The Enforcement Rules for the "Act on Safety Management of Consumer Chemical Products and Biocides" is hereby partially amended as follows:
In Article 4, Paragraph 6, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 6, Paragraphs 8 through 10 and Paragraph 13, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 7-2, Paragraph 1, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 9, Paragraph 3, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 10, Paragraph 2, the first part of Paragraph 3 of the same Article, all parts of Paragraph 4 of the same Article except for each Item, Paragraph 5 of the same Article, the first part of Paragraph 6 of the same Article, and Paragraphs 7 through 9 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 11, Paragraph 1 except for each Item, the main text of Paragraph 2 of the same Article, and the first half of Paragraph 3 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 12, Paragraph 1, except for each Item, and in Paragraph 2 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In the main text of Article 13 Paragraph 3, the first half of Paragraph 4 of the same Article, and Paragraph 5 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 14, Paragraph 2, except for each Item, and in Paragraph 4 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";

In Article 22, Paragraph 1 except for each Item, the main text of Paragraph 2 of the same Article, and the first part of Paragraph 3 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 23, Paragraph 1 except for each Item, and the main text of Paragraph 2 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 24, Paragraphs 2 and 4, the first part of Paragraph 5 of the same Article, the main text of Paragraph 6 of the same Article except for each Item, Item 5 Subitem c. of the same Paragraph, and Paragraph 7 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 25, Paragraph 3, the first half of Paragraph 4 of the same Article, and Paragraph 5 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 28, Paragraph 3, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety," and "of the National Institute of Environmental Research" shall be amended to "of the National Institute of Chemical Safety.";
In the first half of Article 31, Paragraph 1, and Paragraph 2 of the same Article, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";
In Article 33, Paragraphs 2 through 4, "the Head of the National Institute of Environmental Research" shall be amended to "the Head of the National Institute of Chemical Safety.";

Addendum
This Rule shall be enforced from April 30, 2024.

The Enforcement Rules for “the Chemical Substances Control Act” is hereby partially amended as follows:
1. Changing the responsible organization from "Korea Chemicals Management Association" to "Korea Environment Corporation" throughout the document
2. Changing authority from Head of the National Institute of Environmental Research" to "Head of the National Institute of Chemical Safety" for certain responsibilities
3. Updating various forms and references to reflect these organizational changes
4. Modifying hazardous chemicals labeling requirements to be "determined and announced by the Head of the National Institute of Chemical Safety" instead of following the National Institute of Environmental Research public notice
Addendum
This Rule shall be enforced from January 1, 2025. Notwithstanding the above, the amended provisions of Article 12, Paragraph 4 and Item 3, Subitem a. of Appendix 2 shall be enforced from April 30, 2024.
◇Reason for amendment and major points
The amendment transfers certain tasks (receiving and managing chemical substance confirmation details, receiving chemical substance confirmation certificate applications, and protecting submitted data) from the 'Korea Chemicals Management Association' to the 'Korea Environment Corporation', a public institution. Additionally, hazardous chemicals labeling requirements will now be determined by the "Head of the National Institute of Chemical Safety" to improve efficiency in chemical substance management.

Partial amendment of the Enforcement Decree for the Chemical Substances Control Act
The Enforcement Decree for the Chemical Substances Control Act is hereby partially amended as follows:
In Article 22, Paragraph 2, Item 25, "the Association" shall be amended to "the Korea Environment Corporation," and Paragraphs 3 and 4 of the same Article shall each be amended as follows:
③ The Minister of Environment shall delegate the following tasks to the Korea Environment Corporation pursuant to Article 55, Paragraph 2 of the Act:
1. Preparation and implementation of administrative, technical, and financial support measures pursuant to Article 4, Paragraph 4 of the Act;
2. Receipt and management of chemical substance confirmation details pursuant to Article 9, Paragraph 1 of the Act;
3. Certification tasks for chemical substance confirmation pursuant to Article 9, Paragraph 3 of the Act;
4. Receipt of data protection requests and notification of data not subject to data protection (applies only to data submitted to the Korea Environment Corporation) pursuant to Article 52 Paragraphs 1 and 2 of the Act.
④ The Minister of Environment shall delegate the tasks related to administrative, technical, and financial support pursuant to Article 4, Paragraph 2 of the Act to the Association, pursuant to Article 55, Paragraph 2 of the Act.
Addendum
This Decree shall be enforced on January 1, 2025.
◇Reason for revision and main contents
Previously, the tasks of receipt and management of chemical substance confirmation details, receipt of chemical substance confirmation applications, and data protection of submitted data were delegated to the private organization "Korea Chemicals Management Association", but going forward, these tasks will be delegated to the public organization "Korea Environment Corporation" to improve the fairness of chemical substance-related work and strengthen the protection of corporate trade secrets.

This Decree shall be enforced on April 30, 2024.
◇Reason for revision and major points
Previously, the Minister of Environment's authority regarding the approval, change approval, and receipt of change notifications for consumer chemical products subject to safety confirmation, approval for biocides and biocidal products, and the designation, designation change, and assessment of testing and inspection facilities for the safety confirmation of consumer chemical products were delegated to the 'Head of the National Institute of Environmental Research', but going forward, these tasks will be delegated to the 'Head of the National Institute of Chemical Safety' to more efficiently perform duties related to chemical substance management.

Partial amendment of the “Consumer Chemical Products And Biocides Safety Control Act”
The “Consumer Chemical Products And Biocides Safety Control Act” is hereby amended as follows:
Article 6 Paragraph 1 Item 8, and Paragraph 4 Items 4 and 5 in the same Article shall each be deleted.
In Article 48-2, Paragraph 1, the phrase "following deliberation and determination by the Committee on Environmental Dispute Mediation and Damage Relief under Article 4 of the Act on Environmental Dispute Mediation and Environmental Damage Relief (hereinafter referred to as "the Committee")" shall be added to the end, and "the Minister of Environment" shall be amended to "the Committee" in Item 5 of the same Paragraph.
Article 4-2 of the Addendum to Act No. 15511 "“Consumer Chemical Products And Biocides Safety Control Act”" shall be newly established as follows:
"Article 4-2 (Transitional Measures Regarding Prohibition of Sales, etc.) A person who sells or donates a product that falls under any of the following items, or displays, keeps, or stores such products for the purpose of sale or donation, may, notwithstanding Article 35, sell or donate the product, or display, keep, or store the product for the purpose of sale or donation, for the period specified in each Item of the following:
1. Biocidal products manufactured or imported without product approval pursuant to Article 3 Paragraph 1 of the Addendum by the period specified in each Item of the same Paragraph: Within 6 months from the end of the period specified in each Item of Article 3 Paragraph 1 of the Addendum.
2. Biocide treated products manufactured or imported without complying with safety standards and labeling standards pursuant to Article 4 Paragraph 1 of the Addendum by the period specified in each Item of the same Paragraph: Within 6 months from the end of the period specified in each Item of Article 4 Paragraph 1 of the Addendum."
Addendum
Article 1 (Enforcement Date) This Act shall be enforced on January 1, 2025. Notwithstanding the above, the amended provisions of Article 4-2 of the Addendum of the “Consumer Chemical Products And Biocides Safety Control Act” (Act No. 15511) shall be enforced from the date of promulgation.
Article 2 (Transitional Measures on the Consumer Chemical Products and Biocides Management Committee)
Article 3 (Transitional Measures on the Appointment and Dismissal of the Biocidal Product Damage Investigation Team)
◇Reason for amendment and major points
The work of reviewing and deciding on the payment of relief benefits for damages caused by biocidal products, and establishing and operating the Biocidal Product Damage Investigation Team are transferred to the Environmental Dispute Mediation and Damage Relief Committee, and unapproved biocidal products and biocide treated products are allowed to be sold only for 6 months after the manufacture/import period.

Partial amendment of the “Act on Registration, Evaluation, etc. of Chemical Substances”
The “Act on Registration, Evaluation, etc. of Chemical Substances” is hereby amended as follows:
The phrase "hazardous chemical substances" In Article 1 shall be amended to "hazardous and dangerous chemical substances."
Article 2, Item 6 shall be amended as follows, Items 6-2 and 6-3 shall be newly established in the same Article as follows, Item 10 of the same Article shall be deleted, and Item 10-3 shall be newly established in the same Article as follows:
6. "Acute human hazard substances" shall signify chemical substances that may have adverse effects on human health within a short period of time through single or short-term exposure, and which have been designated and announced by the Minister of Environment in accordance with criteria stipulated by Presidential Decree.
6-2. "Chronic human hazard substances" shall signify chemical substances that may have adverse effects on human health through repeated exposure or after undergoing a latent period following exposure, and which have been designated and announced by the Minister of Environment in accordance with criteria stipulated by Presidential Decree.
6-3. "Ecologically hazardous substances" shall signify chemical substances that may have adverse effects on the environment such as to aquatic organisms through short-term or long-term exposure, and which have been designated and announced by the Minister of Environment in accordance with criteria stipulated by Presidential Decree.
10-3. "Unconfirmed hazard substances" shall signify substances that have been registered or notified to the Minister of Environment in accordance with Article 10, but whose hazards are difficult to confirm due to reasons such as the lack of data related to hazards, which meet the criteria stipulated by Decree of the Ministry of Environment.
Paragraph 6 shall be newly established in Article 5 as follows:
⑥ Businesses handling unconfirmed hazard substances shall assume that the substances are hazardous until the lack of hazards is confirmed, and they shall take appropriate measures to prevent such substances from causing harm to human health or the environment.
The phrase "100 kilograms" In Article 10, Paragraph 1 and Paragraph 4, Item 1 shall be amended to "1 ton," and the phrase "100 kilograms or less" in Paragraph 4, Item 2, Subitem a of the same Article shall be amended to "under 1 ton."
In Article 11, Paragraph 1, Item 3, "I" shall be amended to "I.", and the following shall be newly added to the latter part of the same Item:
In this case, when calculating the quantity to be registered in accordance with Article 10, Paragraphs 1 and 5 or notified in accordance with Paragraph 4 of the same Article, the quantity for which confirmation of exemption from registration, etc. has been received shall be excluded.
In Article 14, Paragraph 6, Item 1, "data" shall be amended to "data.", and the following shall be newly added to the same Item as a proviso:
Notwithstanding the above, in case of data corresponding to Paragraph 1 Item 4, the reason for its preparation shall be included.
Article 19-3 shall be newly added to the Partial Amendment to the “Act on Registration, Evaluation, etc. of Chemical Substances” (Act No. 19964) as follows:
Article 19-3 (Review of Chemical Substance Data Submitted on Notification, etc.) ① If necessary to confirm the appropriateness of the classification and labeling of chemical substances notified under Article 10 Paragraph 4, the Minister of Environment may review the appropriateness of the data submitted under Article 14 Paragraph 6.
② The Minister of Environment may investigate the results of related domestic and international reviews, assessments, and tests, or produce necessary data such as hazard test data for the purpose of the review under Paragraph 1.
③ Matters necessary for the review in accordance with Paragraph 1 and for the production, etc. of hazard test data in accordance with Paragraph 2 shall be determined by a Ministry of Environment Decree.

Partial amendment of “the Chemical Substances Control Act”
“the Chemical Substances Control Act” is hereby amended as follows:
Article 2, Items 1 and 2 shall be amended as follows, and Items 2-2 and 2-3 shall be newly established as follows in the same Article, and Items 3 through 5 of the same Article shall be amended as follows:
1. "Chemical substance" signifies a chemical substance as defined in Article 2, Item 1 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
2. "Acute human hazard substance" signifies an acute human hazard substance as defined in Article 2, Item 6 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
2-2. "Chronic human hazard substance" signifies a chronic human hazard substance as defined in Article 2, Item 6-2 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
2-3. "Ecologically hazardous substance" signifies an ecologically hazardous substance as defined in Article 2, Item 6-3 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
3. "Authorized substance" signifies an authorized substance as defined in Article 2, Item 7 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
4. "Restricted substance" signifies a restricted substance as defined in Article 2, Item 8 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
5. "Prohibited substance" signifies a prohibited substance as defined in Article 2, Item 9 of the “Act on Registration, Evaluation, etc. of Chemical Substances”.
In Article 2, Item 7, The phrase "toxic substances, authorized substances, restricted substances or prohibited substances, accident-prone substances, and miscellaneous chemical substances that are or have the potential to be harmful or hazardous" shall be amended to "acute human hazard substances, chronic human hazard substances, ecologically hazardous substances, and accident-prone substances," and Item 8 of the same Article shall be deleted.
Item 15 shall be newly established in Article 3, Paragraph 1 as follows, and "Item 14" in Paragraph 3 of the same Article shall be amended to "Item 15."
15. Designated wastes in accordance with Article 2, Item 4 of the Wastes Control Act (limited to those handled by waste disposal businesses under Article 25, Paragraph 5, Items 1 through 4 of the same Act)

1. Amendment outline
This amendment covers the additional designation of existing biocidal substances notified in accordance with Article 18, Paragraph 3 of the amended "“Consumer Chemical Products And Biocides Safety Control Act”" (effective March 24, 2020) as existing biocidal substances subject to deferment of approval, and the cancellation of designations as existing biocidal substances subject to deferment of approval in accordance with Article 19, Paragraph 3.
2. Major points
a. Additional designation of existing biocidal substances subject to deferment of approval
- Nos. "13", "17", "46", "79", and "278" in the [Annex] are additionally designated as existing biocidal substances subject to deferment of approval, and are granted a grace period for approval
b. Additional designation of biocidal product types for previously designated substances
- Nos. "103", "116", "125", "190", "221", and "336" in the [Annex] are additionally designated for biocidal product types that may be used, and are granted a grace period for approval
c. Cancellation of designation as existing biocidal substances subject to deferment of approval
- Reason for amendment: Designation canceled due to lack of application for substance approval by the notifying company, etc.
- Cancellation of designation of existing biocidal substances subject to deferment of approval for the substances listed in the [Annex]
d. Changing the serial numbers from "13 through 460" to "13 through 360" in the [Annex]

Administrative Notice of Partial Amendment (Draft) to the "Regulation on Regulated Quantities for Toxic Substances, Restricted Substances, Prohibited Substances and Authorized Substances"
1. Reasons for amendment
This amendment establishes regulated quantities for each toxic substance newly designated by the amendment to the "Designation of Toxic Substances" (National Institute of Environmental Research, Nov. 17, 2023), to classify substances regarding the submission of chemical accident prevention and management plans (Group 1, Group 2, Exemption).
2. Major points
a. Establishment of upper and lower regulated quantities for new toxic substances (56 substances)
3. Submission of opinions
Organizations, groups, or individuals with opinions on this amendment are invited to review the amendment on the Ministry of Environment website (www.me.go.kr, Communication with Citizens → Citizens' Participation → Online Public Hearing) by February 12, 2024, and submit a written opinion containing the following information to the Minister of Environment (Head of Chemical Safety Department).

The "Notice on Hazard/Risk Investigation of New Chemical Substances" is hereby amended and announced as follows.

Partial Amendment to the Notice on Hazard/Risk Investigation of New Chemical Substances
1. Reasons for amendment
Some polymer compounds composed only of chemicals that are not new chemical substances are excluded from the hazard/risk investigation of new chemical substances. The aim of the amendment is to reasonably improve the criteria for the polymer compounds excluded from hazard/risk investigation. In addition, while Article 85, Item 18 of the Decree stipulates 'Substances recorded in the list of chemical substances announced by the Minister of Employment and Labor in consultation with the Minister of Environment,' no such regulation currently exists, therefore this is to be newly established as an annex.
2. Major points
a. Reasonable improvement of criteria for polymer compounds excluded from hazard/risk investigation (Article 6)
b. Establishment of 'Substances recorded in the list of chemical substances announced by the Minister of Employment and Labor in consultation with the Minister of Environment' as stipulated in Article 85, Item 18 of the Decree (Annex Table 2).

Administrative Notice of Abolition (Draft) of the "Hazard Assessment Results of Chemical Substances Other Than New Chemical Substances"
1. Reason for abolition
The "Hazard Assessment Results of Chemical Substances Other Than New Chemical Substances" was previously announced in accordance with Articles 11 and 13 of the former Toxic Chemicals Control Act and Article 9 of its Enforcement Rule. However, it is now being duplicated with the "Hazard Assessment Results of Chemical Substances" under Article 21 of the current "Act on Registration and Evaluation of Chemical Substances" and Article 28 of its Enforcement Rule, so the notice is to be abolished.
2. Main contents
Abolition of the "Hazard Assessment Results of Chemical Substances Other Than New Chemical Substances"
