1. Reasons for amendment
A. Explanation of some items in the scope and method of preparing application data stated in the notice is missing or needs to be updated
B. Improve the convenience of applicants in preparing data by specifying the method of preparing component analysis data for biocidal substances and biocidal products and relaxing the procedure for exempting efficacy test data
2. Main contents of amendment
A. Add definitions and prepare the scope of submitted data according to the establishment of the biocidal product family system
- Add definitions within the regulations and specify the data to be submitted when applying for a biocidal product family in [Annex 1] Scope of Preparing Application Data for Approval of Biocidal Substances and Biocidal Products
- Reflect the contents of the guideline for approval of biocidal product families (published in Mar. 2023)
B. Specify the method of preparing component analysis data for biocidal substances and biocidal products in [Annex 5]
- Provide detailed descriptions of considerations when setting specifications for biocidal substances and impurities
- Describe detailed requirements for test data on component analysis of biocidal substances
- Reflect the guidelines for preparing data for approval of biocidal substances (published in Sep. 2021) and products (published in Sep. 2022)
C. Revise the procedure for exempting efficacy test data for biocidal products in [Annex 10]
- Relax the procedure for exempting efficacy test data for biocidal substances
D. Other terminology revisions
- Correct spacing and unify descriptive styles in the regulations and annexes

Addenda
Article 1 (Effective Date) This Notice shall come into effect 3 months after date of its announcement.
Article 2 (Transitional Measures) Notwithstanding the provisions of Art. 1, those who handle newly designated "Toxic Substances" (including cases of which concentration limits have changed) in accordance with the Chemical Substance Control Act (CCA), prior to the effect day of this Notice, shall comply with the following requirements by the dates specified in each subparagraph as stipulated:

1. Reasons for amendment and main contents
Chemical substances manufactured by recycling waste are also subject to the registration obligation under Article 10 of "the Act on the Registration and Evaluation of Chemicals". However, in the European Union (EU), which operates a similar system to Korea, recycled chemical substances that are identical to those already registered by other business entities are exempted from registration. Therefore, the amendment aims to exclude chemical substances manufactured by recycling waste from the registration requirement if they are identical to substances already registered by other business entities.

According to Article 11, Paragraph 1 of "the Act on the Registration and Evaluation of Chemicals", chemical substances for which some of the data required for registration under Article 10 of the same Act can be omitted are required to submit reasons for omission and supporting documents in accordance with Article 5 of the Enforcement Rule of the same Act. However, the submission of supporting documents is required even in cases where it can be confirmed that the substance is subject to omission through the hazard assessment results disclosed by foreign governments, etc. Therefore, the amendment aims to specifically stipulate cases where the submission of supporting documents is unnecessary.

In accordance with the "Act on the Registration and Evaluation of Chemical Substances", the main contents of the "Designation of Toxic Substances" are widely announced to the public and opinions are sought in accordance with Article 46 of the “Administrative Procedures Act” as follows:

Administrative Notice of Partial Amendment to the "Designation of Toxic Substances"
1. Reason for amendment
To designate substances with high hazards as new Toxic Substances among those for which hazard assessment has been completed in accordance with the "Act on the Registration and Evaluation of Chemical Substances".
2. Main contents
A. New designation of Toxic Substances for which hazard assessment has been completed according to the "Act on the Registration and Evaluation of Chemical Substances" and other amendments
- Newly establish rows from "2023-1-1119" to "2023-1-1174"
- Revise the name of the chemical substance in row "2017-1-758"
B. Transitional measures (addendum) for import notification, business permits, labeling of hazardous chemicals, and handling standards under the Chemical Substances Control Act for newly designated Toxic Substances
3. Submission of opinions
Individuals, organizations, and groups (associations) who have opinions on this notice, please submit a written opinion including the following items to the Head of the National Institute of Environmental Research (Hazard Assessment Research Division, tel. 032-560-8494, fax 032-568-2038) by October 23, 2023.

Partial Amendment to the Enforcement Rule of "the Chemical Substances Control Act"
The Enforcement Rule of "the Chemical Substances Control Act" is partially amended as follows:
In Article 14, Paragraph 2, "shall issue" is changed to "shall issue, and the head of the local environmental office shall send a copy of the permit to the head of the local employment and labor office with jurisdiction."
In Annex 6, Item 2(a)(1), "Chemical Safety, Chemical Engineering, Gas, Air Management, Water Quality Management, Waste Treatment, or Industrial Hygiene Management Professional Engineer or Hazardous Materials or Gas Master Craftsman" is changed to "Chemical Safety Professional Engineer, Chemical Engineering Professional Engineer, Gas Professional Engineer, Air Management Professional Engineer, Water Quality Management Professional Engineer, Waste Treatment Professional Engineer, Industrial Hygiene Management Professional Engineer, Surface Treatment Professional Engineer, Hazardous Materials Master Craftsman, Gas Master Craftsman, or Surface Treatment Master Craftsman certificate."
In the same item (3), "Chemical Engineering, Explosives Manufacturing, Industrial Safety, Gas, Industrial Hygiene Management, Water Environment, Air Environment, or Waste Treatment Engineer" is changed to "Chemical Engineering Engineer, Fine Chemistry Engineer, Explosives Manufacturing Engineer, Environmental Risk Management Engineer, Chemical Analysis Engineer, Industrial Safety Engineer, Gas Engineer, Industrial Hygiene Management Engineer, Water Environment Engineer, Air Environment Engineer, or Waste Treatment Engineer."
In the same item (4), "Explosives Manufacturing, Industrial Safety, Water Environment, Air Environment, Waste Treatment, Hazardous Materials, Gas, Industrial Hygiene Management Industrial Engineer or Environment, Hazardous Materials, Gas Technician" is changed to "Explosives Manufacturing Industrial Engineer, Industrial Safety Industrial Engineer, Water Environment Industrial Engineer, Air Environment Industrial Engineer, Waste Treatment Industrial Engineer, Hazardous Materials Industrial Engineer, Gas Industrial Engineer, Industrial Hygiene Management Industrial Engineer, Surface Treatment Industrial Engineer, Environment Technician, Hazardous Materials Technician, Gas Technician, Chemical Analysis Technician, Surface Treatment Technician, or Toxic Substance Handling Technician under the Enforcement Decree of "the National Technical Qualifications Act" (referring to the version before the amendment by Presidential Decree No. 15794)."
Addendum
This rule shall take effect from the date of promulgation. However, the amended provisions of Notes 2 and 2-2 of Annex 6-2 shall take effect from January 1, 2025.

Partial Amendment to the Enforcement Decree of "the Chemical Substances Control Act"
The Enforcement Decree of "the Chemical Substances Control Act" is partially amended as follows:
In Article 12, Paragraph 2, Item 1, "Waste Treatment Engineer or Industrial Hygiene Engineer" is changed to "Waste Treatment Engineer, Industrial Hygiene Engineer, or Surface Treatment Engineer", and Item 1-2 is newly inserted as follows:
1-2. A person who holds a qualification as a Gas Master Craftsman, Hazardous Materials Master Craftsman, or Surface Treatment Master Craftsman under "the National Technical Qualifications Act"
In Article 12, Paragraph 2, Item 2, "Chemical Engineer" is changed to "Chemical Engineer, Fine Chemistry Engineer, Explosives Manufacturing Engineer, Environmental Risk Management Engineer, or Chemical Analysis Engineer", and in Item 3 of the same paragraph, "Industrial Safety Industrial Engineer" is changed to "Explosives Manufacturing Industrial Engineer, Industrial Safety Industrial Engineer", and "Gas Industrial Engineer or Industrial Hygiene Management Industrial Engineer" is changed to "Gas Industrial Engineer, Industrial Hygiene Management Industrial Engineer, or Surface Treatment Industrial Engineer", and in Item 4 of the same paragraph, "Environmental Technician or Hazardous Materials Technician" is changed to "Environmental Technician, Hazardous Materials Technician, Chemical Analysis Technician, or Surface Treatment Technician".
Article 25 is deleted.
Addendum
This decree shall enter into force on the date of its promulgation.
