Pursuant to Articles 16 and 25 of the "Consumer Chemical Products And Biocides Safety Control Act," Articles 13, 22, 38(1)(22-2), and 38(1)(22-3) of the Enforcement Decree of the same Act, and Articles 13(5) and 25(5) of the Enforcement Rule of the same Act, the necessary matters regarding the criteria for recognizing technical equivalence of substances and product similarity, the scope of preparation of application materials for recognition, and the methods of preparation are announced as follows:

Chapter 1: General Provisions
Article 1 (Purpose)
The purpose of this notice is to stipulate the necessary matters concerning the criteria for recognizing technical equivalence of substances and product similarity, the scope of preparation of application materials for recognition, and the methods of preparation, in accordance with Articles 16 and 25 of the "Consumer Chemical Products And Biocides Safety Control Act" (hereinafter referred to as "the Act"), Articles 13 and 22 of the Enforcement Decree of the same Act (hereinafter referred to as "the Decree"), and Articles 13(5) and 25(5) of the Enforcement Rule of the same Act (hereinafter referred to as "the Rule"), as well as Articles 38(1)(22-2) and 38(1)(22-3) of the Decree.
Article 2 (Definitions)
The terms used in this notice are defined as follows:
"Active substance" refers to a substance in a biocidal product that has the function of eliminating, neutralizing, or inhibiting harmful organisms.
"Additive" refers to a substance intentionally added during the production of a biocidal product to stabilize it against light, oxidation, or UV rays, excluding pH adjusters and dyes.
"Impurity" refers to a substance unintentionally generated during the manufacturing process of a biocidal product, resulting from the ingredients used, secondary reactions between the ingredients, or incomplete reactions.
"Major impurity" refers to an impurity present in a substance in an amount of 1 g/kg or more.
"Purity" refers to the sum of the concentrations of active substances in a biocidal product.
"Reference biocidal substance" refers to a biocidal substance approved by the Minister of Environment pursuant to the main text of Article 12(1) of the Act, against which a biocidal substance applied for technical equivalence of substances recognition under Article 16(1) of the Act is compared.
"Reference biocidal product" refers to a biocidal product approved by the Minister of Environment pursuant to the main text of Article 20(1) of the Act, against which a biocidal product applied for product similarity recognition under Article 25(1) of the Act is compared.
Other terms used in this notice shall be interpreted in accordance with the "Regulations on the Classification and Labeling of Chemical Substances" (National Institute of Environmental Research Notice, hereinafter referred to as the "Classification and Labeling Regulations"), the "Regulations on the Scope and Methods of Preparation of Application Materials for Biocidal Substances and Biocidal Products" (National Institute of Environmental Research Notice, hereinafter referred to as the "Application Preparation Regulations"), the "Regulations on the Methods of Preparation of Registration Materials and Hazard Assessment" (National Institute of Environmental Research Notice), the "Regulations on the Specific Methods for Risk Assessment of Chemical Substances" (National Institute of Environmental Research Notice), the "Regulations on the Test Methods for Biocidal Products" (National Institute of Environmental Research Notice), and the "Regulations on the Test Methods for Chemical Substances" (National Institute of Environmental Research Notice).

Pre-Notice on Partial Amendment on the Enforcement Rule of the “Act on the Registration and evaluation of Chemical Substances”
Reasons for Amendment
The amendment of the Act on the Registration and Evaluation of Chemical Substances (Act No. 19172, partially amended on January 3, 2023, effective January 4, 2024) requires a change report if there is a change in important items of notification regarding Substances Subject to Intensive Control contained in products. It also allows the transfer of rights and obligations to a person who has registered or reported a chemical substance or received a registration exemption confirmation, or in the event of a merger of a corporation.
In accordance with this amendment, the Ministry of Environment will establish the procedures and fees for change reports of Substances Subject to Intensive Control contained in products and change reports of the status of persons who have registered or reported chemical substances. It will also improve and supplement some of the shortcomings of the current system that have been identified in its operation, such as requiring the indication of registration or reporting instead of registration number or reporting number when transferring registered chemical substances without submitting hazardous materials data to strengthen the protection of corporate trade secrets.
Major Changes
Simplification of information for the transfer of chemical substances (Art. 36 1 of the proposed amendment)
Implementation of change report of Substances Subject to Intensive Control contained in products, etc. (Proposed Art. 42 newly established) for following cases:
The total amount of Substances Subject to Intensive Control contained in a product has increased by 50% or more or the composition of the importer or entrustee of a product containing Substances Subject to Intensive Control has changed.
Content of Substances Subject to Intensive Control contained in a product has changed by 30% or less, the change report is not required
Procedures for the succession of the status of persons who have registered or reported chemical substances, etc. (Art. 55-3 newly established)

Reasons for Amendment
The reason for this amendment is to establish the newly established fines and penalties, and to determine the matters delegated by the law and the matters necessary for its implementation, in accordance with the amendment of the Act on the Registration and Evaluation of Chemical Substances (such as change reports of major matters regarding Substances Subject to Intensive Control in products or allowances for the transfer of rights and obligations to a person who has registered or reported a chemical substance or received a Registration Exemption Confirmation, or in the event of a merger of a corporation), which was enacted on January 3, 2023 (Act No. 19172, partially amended, effective January 4, 2024).
Major changes
Establishment of grounds for processing of change reports of Substances Subject to Intensive Control - containing products and reports of the transfer of status of persons who have registered or reported chemical substances, etc., through the chemical substances information processing system, and delegation or entrustment, etc. (Art. 21, Art. 22, and Art. 31 of the proposed amendment)
Establishment of grounds for imposing fines for failure to comply with the change report Substances Subject to Intensive Control contained in products and failure to report the transfer of status of persons who have registered or reported chemical substances, etc. (Annex 6)

Article 1 (Effective Date) This Notice shall come into effect 3 months after date of its announcement.
Article 2 (Application) The provisions of Art. 24 of the "Chemical Substance Control Act" (hereinafter referred to as the "CCA") on the installation and management standards of handling facilities and Art. 28 on the permission to conduct hazardous chemical substance business shall apply to newly designated Toxic Substances (including those with changed content standards) as of January 1, 2025, in accordance with the implementation of this Notice.

Notification of import approval for Prohibited Substances to the Ministry of Employment and Labor (Proposed amendment to Art. 14)
Applicant must submit a copy of the approval for Substances Prohibited from Manufacturing, etc. to MOE and MOE must notify the details of the approval (under Art. 117 of “Occupational Safety and Health Act”) to Ministry of Employment and Labor (MOEL) when approving the import or sale of Prohibited Substances.
Extension of the validity period and expansion of the qualifications recognized for technical personnel by the National Institute of Chemical Safety (Proposed amendment to Annex 6)
Extension of the validity period of the training course on the Safe Management of Handling Facilities conducted by the National Institute of Chemical Safety for businesses with fewer than 30 employees.
Addition of National technical qualifications, such as the Engineer Environmental Risk Managing to the scope of qualifications.

MOE Announcement 2023-435 Pre-Notice of Decree on Partial Amendment for the “Enforcement Decree of the Chemical Substance Control Act”
Reasons for Amendment
Some National Technical Qualifications that evaluate the expertise in the chemical safety field, such as surface treatment qualification, will be added to the qualifications recognized as hazardous chemical substance supervisors, and to delete the regulation on the re-examination of regulations on hazardous chemical substance supervisors.
Changes in Pre-Notice
Expansion of the scope of qualifications recognized as qualifications for Hazardous Chemical Substance supervisors (Proposed Amendment to Art. 12)
Addition of qualifications related to the fields of fine chemistry, surface treatment, chemical analysis, and gunpowder manufacturing to the qualifications recognized as hazardous chemical substance supervisors
Include the environment risk management technician, gas craftsman, and hazardous material craftsman in the qualifications for hazardous chemical substance supervisors as stipulated in the Enforcement Decree of the "Regulations on the Grant of Business Permits for Hazardous Chemical Substances"
To reflect the results of the review of regulations under the “Administrative Regulation Basic Act”, the reexamination deadline for regulations related to hazardous chemical substance supervisors will be abolished (deletion of Art. 25 of the proposed amendment)

1. Reasons for Amendment
Regulated quantities of each chemical substance are specified to classify the subject of submitting Chemical Accident Prevention and Management Plans (as 1st, 2nd, and exemption) since information such as regulated concentration of newly designated toxic substances and toxic substances that have already been designated have changed due to the revision of the “Designation of Toxic Substances” (National Institute of Environmental Research, June 1, 2023).

Administrative Notice of Partial Amendment for「Regulations On Classification And labeling Of Chemicals」
○ Reasons for Amendment
In accordance with the results of the hazard assessment under the 「Regulations On Classification And labeling Of Chemicals」, a classification and labeling notice will be issued for newly designated toxic substances, and the classification and labeling notice for existing hazardous chemicals that have completed hazard assessment through change of registration, etc. will be revised.
○ Major Changes in Administrative Notice
A. A new hazard classification and labeling will be added for newly designated toxic substances, based on the results of the hazard review of registered chemical substances
- The necessary information for the hazard classification and labeling of three substances, including "Cobalt manganese nickel oxide", will be announced
- ID numbers “2023-1-1116”through “2023-1-1118” will be added
B. Revision of the classification and labeling of existing hazardous chemicals that have changed in hazard due to additional data
- The classification and labeling of five toxic substances in category A (ID numbers “97-1-24”, “97-1-106”, “97-1-171”, “97-1-205”, and “97-1-547”) are added or revised
- ID number “06-5-14” is newly added to Category C Restricted Substance

Administrative Notice for Partial Amendment of “Notice of Designation of Toxic Substances”
1. Reason for Amendment
In accordance with the “Act on Registration, Evaluation, etc. of Chemical Substances”, substances with high hazard levels among substances that have completed Hazard Review are to be newly designated as toxic substances.
2. Major Points
a. Amendments to new designations of toxic substances that have undergone hazard evaluation, in accordance with the “Act on Registration, Evaluation, etc. of Chemical Substances”
- Identification numbers “2023-1-1116” to “2023-1-1118” are newly established
- Amendments to the names of chemical substances with the identification numbers “97-1-24”, “97-1-106”, “97-1-205” and “2005-1-547”
b. Regulations on import declaration and business licenses under the Chemical Substances Control Act, labeling of hazardous chemical substances, and transitional rules for handling standards for newly designated toxic substances (Addendum)
3. Submission of Opinions
Individuals, institutions, and organizations(associations) which have opinions on this public notice may submit a written opinion to the Director of the National Institute of Environmental Research (Risk Assessment Research Department, 032-560-8494(Phone), 032-568-2038(Fax)) by July 10, 2023 with the following: .
a. Opinions on the notice by item(whether it should be revised, and reasons for such)
b. Name (for organizations, the names of the organization and its representative), address and phone number
