[Presidential Decree No. 32300] Partial Amendment Of Enforcement Decree Of "The Consumer Chemical Products And Biocides Safety Control Act"
◇Reasons for amendment
In order to promptly redress damages caused by the use of defective biocidal products, the Minister of Environment shall be authorized to provide compensation to those who have suffered damages as a result of such use, and to impose and collect a share of the compensation cost on manufacturers or importers of the relevant products. These provisions are in accordance with the amended " Consumer Chemical Products And Biocides Safety Control Act" and its enforcement decree, and aim to establish procedures for applying for compensation for damages caused by biocidal products, criteria and scope for providing compensation for such damages, and procedures for the installment payment of the share of compensation cost.
◇Main contents
A. Composition of Biocidal Product Damage Investigation Team (Article 37-3)
A biocidal product damage investigation team referred to in Article 48-3 (1) of the Act shall consist of up to 20 team members, including one chief.
B. Effective Period for Decisions on Payment of Remedial Benefits for Damage from Biocidal Products (Article 37-5)
The effective period for a decision on payment of remedial benefits for damage from biocidal products under Article 48-5 (1) of the Act shall be five years. A person who intends to apply for renewal of the effective period shall submit an application for renewal of the effective period to the Minister of Environment.
